Memorandum in Support of
Motion to Compel Discovery for Michael Walli

The Motion to Compel Discovery is filed at this time in order to preserve the rights of Mr. Walli to full and proper discovery in light of the Court's August 25, 2006 deadline for discovery motions.

Undersigned counsel has only recently enrolled in this matter for Mr. Walli and has not yet seen any discovery.

It is understood that some discovery has been provided directly to Mr. Walli while he was proceeding pro se, but undersigned has not seen any of that discovery as Mr. Walli, who is in jail and indigent, does not have the funds to make and send copies to the undersigned. Further, Mr. Walli reports to counsel that several matters that were to be disclosed have not yet been provided.
